Submission of a quote request or consultation form does not obligate the customer to purchase and does not obligate Window Hub to accept a project.
4. Measurements and Product Specifications
Many Window Hub products are manufactured or configured for specific openings and project requirements. Accurate measurements and specifications are therefore essential.
When Window Hub performs final measurements, those measurements may be used for manufacturing and installation subject to the applicable project agreement.
When a customer, architect, builder, contractor, designer, or other third party provides measurements, specifications, drawings, opening dimensions, or other project information, the customer is responsible for ensuring that such information is complete and accurate unless
Window Hub has expressly agreed in writing to verify it.
Window Hub is not responsible for manufacturing or installation issues caused by inaccurate information provided by the customer or another third party to the extent permitted by applicable law.
Product dimensions, appearance, glass characteristics, colors, hardware, finishes, samples, photographs, digital renderings, and other representations may vary slightly from their appearance on screens or in marketing materials due to manufacturing tolerances, lighting, monitor settings, material characteristics, or product updates.
Final specifications are those contained in the applicable written order or project agreement.
5. Custom and Made-to-Order Products
Many windows, doors, glass units, frames, and related products offered by Window Hub are custom manufactured or configured for a specific project.
Once an order has been approved and production has begun, modifications or cancellations may result in additional costs or may not be possible, subject always to any cancellation or other rights provided by applicable law and the applicable written contract.
Customers are responsible for carefully reviewing and approving applicable specifications, including dimensions, opening direction, configuration, glazing, color, finish, hardware, quantity, and other material project details before production.
Any change requested after approval may affect price, manufacturing time, delivery, and installation schedules.
6. Orders, Deposits, and Payment
Payment schedules, deposits, progress payments, final payments, accepted payment methods, financing arrangements, and other financial terms for a particular project will be stated in the applicable estimate, proposal, invoice, sales agreement, installation agreement, or other written contract.
Unless expressly stated otherwise in writing:

Website submissions do not constitute acceptance of an order;

an order is not considered accepted until Window Hub confirms acceptance in accordance with the applicable project documentation;

taxes, permits, delivery charges, installation costs, disposal costs, or other project expenses may be additional where they are not expressly included in a quote.
Window Hub will not require payment in a manner prohibited by applicable law.
7. Cancellations and Changes
Cancellation and modification rights may vary depending on the type of transaction, location of the project, stage of manufacturing, and applicable law.
For qualifying home improvement contracts in New Jersey, customers may have statutory cancellation rights, including the right to cancel certain contracts within the period established by New Jersey law. Where required, the applicable written contract will contain the legally required cancellation notice and instructions.
Nothing in these Terms is intended to waive, limit, or replace a consumer right that cannot legally be waived.
After any applicable statutory cancellation period has expired, custom or made-to-order products may be non-cancelable once manufacturing has begun, as specified in the applicable project agreement.
Customer-requested changes after an order is approved may require a written change order and may result in additional charges or revised project schedules.
8. Manufacturing, Delivery, and Project Timelines
Window Hub may provide estimated manufacturing, delivery, or installation timeframes. Any timeframe described on the Website is a general estimate unless specifically guaranteed in a signed written agreement.
Actual schedules may be affected by circumstances including:

supplier delays;

transportation and freight conditions;

A delay does not automatically constitute a breach or entitle a customer to compensation except where required by applicable law or expressly stated in the applicable written agreement.
9. Installation and Site Conditions
Where Window Hub provides installation services, the scope of installation will be described in the applicable project agreement.
The customer is responsible for providing reasonable access to the property and work areas at scheduled times and for informing Window Hub in advance of known site conditions that may affect the project.
Unless otherwise agreed in writing, customers should ensure that areas immediately surrounding the installation location are reasonably accessible and that fragile, valuable, or personal property is moved away from the work area.
Installation may reveal previously concealed conditions that could not reasonably have been identified during an initial inspection or measurement, including water damage, rot, mold, structural deterioration, non-compliant construction, concealed wiring or plumbing, asbestos-containing materials, or other conditions.
Additional work required because of concealed or unexpected conditions may require a revised scope, change order, additional charge, or involvement of another qualified professional.
Window Hub will comply with applicable laws and will not knowingly perform work that is unsafe or prohibited.
10. Permits, Codes, and Third-Party Approvals
Responsibility for permits, inspections, homeowners' association approvals, architectural approvals, landlord consent, or other third-party permissions will be determined by the applicable project agreement and local requirements.
Customers are responsible for providing accurate information concerning property ownership, building restrictions, association requirements, and other conditions relevant to the project.
Window Hub may suspend work if required approvals are missing or if continuing the project would violate applicable law, building codes, safety requirements, or contractual obligations.
11. Inspection and Notification of Issues
Customers should inspect delivered and installed products within a reasonable period and notify Window Hub promptly if they believe products have been damaged, delivered incorrectly, or installed inconsistently with the applicable project agreement.
Notification should include sufficient information to identify the project and the issue, together with photographs or other supporting information when reasonably available.
Reporting an issue does not automatically establish that a product or service is defective or covered by warranty. Window Hub may inspect the product or installation before determining the appropriate resolution.
12. Product and Workmanship Warranties
Certain Window Hub products and services may be covered by manufacturer, product, hardware, glass, workmanship, or other warranties.
Applicable warranty coverage may depend on the particular product, component, project, installation method, and date of purchase.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

Actual performance may vary depending on product configuration, glass package, installation, building construction, climate, orientation, maintenance, and other conditions.
Technical values, performance ratings, examples, photographs, diagrams, and product descriptions should be interpreted in connection with the particular product and project specifications.
Information on the Website should not be treated as architectural, engineering, structural, legal, tax, or other professional advice.
Where a project requires professional engineering, architectural review, structural analysis, or another specialized service, the customer should obtain advice from an appropriately qualified professional.

Unless stated otherwise, promotional offers:

To the extent permitted by applicable law and the applicable project agreement, Window Hub will not be responsible for delays or failures caused by events beyond its reasonable control, including severe weather, natural disasters, fire, transportation interruptions, supply-chain disruptions, material shortages, labor disruptions, government actions, utility outages, acts of war or terrorism, public emergencies, or similar events.
Window Hub will make reasonable efforts to communicate material project delays and resume performance when reasonably possible.
26. Governing Law
These Website Terms are governed by the laws of the State of New Jersey and applicable federal law, without regard to conflict-of-law principles, except where the law of another jurisdiction must apply as a matter of law.
Any project-specific contract may contain additional provisions concerning governing law, jurisdiction, dispute resolution, mediation, arbitration, or other procedures.
Nothing in these Terms deprives a consumer of protections or remedies that cannot legally be waived under applicable federal, state, or local law.
27. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary to comply with applicable law.
The remaining provisions will continue in full force and effect.
28. No Waiver
Failure by Window Hub to enforce a provision of these Terms on one occasion does not constitute a waiver of that provision or our right to enforce it in the future.
